Terms of Use

These terms cover the NoBrainer app for iPhone and iPad, made by Natively (“we,” “us”). By installing or using the app you agree to them. Apple’s standard licensed application terms also apply to any app from the App Store.

What the app is

NoBrainer is a collection of games. It is entertainment. It is not a medical device, a treatment, a diagnostic tool or a training program, and we make no claims about its effect on memory, attention or any other ability. Scores and levels inside the app are game scores and nothing more.

Free play and NoBrainer Plus

• Every game is free to play for up to one hour a day, counted on your device.
• NoBrainer Plus removes the daily hour. Nothing else changes: no game, setting or accessibility feature is held back from free players.
• Plus is an auto-renewing subscription sold through Apple: monthly, or yearly with a free trial on the yearly plan where offered. The price is shown in the app before you buy, in your local currency.
• Payment is charged to your Apple account at confirmation of purchase. The subscription renews automatically unless you turn off auto-renew at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the end of the period.
• You manage and cancel the subscription in your Apple account settings. Cancelling stops the next renewal; the current period runs to its end. Any unused part of a free trial is forfeited when you buy a subscription.
• Refunds are handled by Apple under Apple’s policies.

Your data

Your play history and settings stay on your device. We run no accounts and collect nothing. Details are in the NoBrainer Privacy Policy.

Using the app

• The app and its games, words, pictures and marks are ours or used under license. You may use them to play, not to copy or resell.
• Do not reverse engineer the app, except where the law allows it regardless of these terms.
• The word lists in the language games come from a public domain list and may contain words you find unpleasant; we filter the obvious ones and welcome reports of others.

Availability and changes

We may add, change or remove games and features. If a change would take something away from a paid subscription, we announce it in the app before it happens. We may stop offering the app; if we do, any unused subscription time is refunded through Apple.

No warranty, limited liability

The app is provided as is. To the extent the law allows, we are not liable for any loss arising from use of the app, and our total liability is limited to the amount you paid us in the twelve months before the claim. Nothing here limits rights that consumer law gives you and that cannot be waived.

Governing law

These terms are governed by the laws of the State of New York, United States, without regard to its conflict of law rules.
